Hampshire County Release Meaning
Modern adult jail custody in Hampshire County is regional and state run. The Hampshire County Sheriff does not operate the current adult jail. A local arrest usually leads to Potomac Highlands Regional Jail and Correctional Facility in Augusta, which the West Virginia Division of Corrections and Rehabilitation, or WVDCR, operates for five counties. That regional role matters. A name attached to Potomac Highlands does not, by itself, prove that the charge arose in Hampshire County.
A release can end physical confinement while leaving a case, sentence, or supervision term open. Bond and recognizance can return a person to the community while charges continue. Time served may end the custody part of a sentence. Parole is conditional release from prison, while probation is court supervision that may follow or replace jail. A dismissal can remove one basis for custody without resolving another hold. Transfer means the person left one facility but stayed in government custody.
- Discharge
- The end of the stated correctional or supervision authority, supported by an agency or court record.
- Time served
- A sentence credited as already satisfied by time spent in custody.
- Detainer
- A request or notice from another authority that can affect where the person goes next.
- Expungement
- A court-ordered process that can remove qualifying records from ordinary public access.
Hampshire County Release Paths
Read the event and destination together. The same departure time can describe very different outcomes. WVDCR may release a detainee under a court order, move a sentenced person inside its system, or turn someone over to another authority. The Hampshire court file then explains the order behind a local case, while the facility record shows when the physical departure occurred.
| Release or exit type | What it means | Best next record |
|---|---|---|
| Bond or recognizance | Jail custody ends while the case may remain pending. | Court bond order plus the PHRJCF departure record |
| Time served or sentence completion | The ordered custody term ends, though supervision or another matter may remain. | Sentencing record and WVDCR release entry |
| Parole or probation | The person is in the community under state or court conditions. | Parole decision, WVDCR status, or probation order |
| Dismissal | One case ends, but other holds must still be checked. | Signed dismissal order and facility departure record |
| Transfer | The person leaves PHRJCF but remains in custody. | Movement entry and receiving-facility record |
| Federal or ICE handoff | Regional-jail control ends as another authority assumes custody. | Receiving agency locator or custody record |
Death in custody is not a routine release and should never be inferred from a missing roster entry. Any such event requires direct, authoritative confirmation. Likewise, a court order authorizing release does not prove that processing finished at that same moment.
Note: Record the stated exit reason and destination separately because one describes authority while the other shows where custody led next.
Hampshire County Release Record Fields
No public agency page promises one Hampshire County release certificate with a fixed field set. Ask for existing records and name the fields needed. WVDCR holds the operational booking and departure records for Potomac Highlands. The court clerk holds the bond, dismissal, sentence, probation, or other order that supplied legal authority. Some fields can be redacted or withheld under law.
| Field to request | What it helps establish |
|---|---|
| Committed name and aliases | Connects spelling variants to the same custody event. |
| OID or booking identifier | Distinguishes people who share a name. |
| Admission date and time | Sets the start of the specific confinement. |
| Originating county and agency | Tests whether a regional-jail record belongs to a Hampshire case. |
| Charges and case number | Links the custody entry to the right court branch. |
| Release date and time | Records the actual facility departure when maintained. |
| Release reason or authority | Shows the recorded basis, such as bond, order, completion, or parole. |
| Destination or receiving agency | Separates community release from transfer or custodial handoff. |
Supporting records may include a release report, release-book entry, commitment order, release order, transport entry, property receipt, or booking image. Request only what already exists. A public body does not have to create a new explanation or combine fields into a custom report.
Key distinction: An active roster answers who is listed now. A historical release record answers how and when a named confinement ended.
Request Hampshire County Release Records
Send the request to the custodian that created each part of the event. For a Potomac Highlands departure, use the WVDCR public-record request channel. Ask the Hampshire County Sheriff only for sheriff-created arrest material. Seek the judicial order from the correct clerk. A narrow date range and clear identifiers make partial production easier when protected details require redaction.
- Identify the person by full name, documented aliases, date of birth or OID if known, facility, Hampshire case number, and a narrow date range.
- Ask WVDCR for existing admission and departure fields, including date, time, stated reason, destination, receiving agency, release report, and release-book entry.
- Request an electronic copy in a native or readily exportable form. Ask that nonexempt parts be produced if other parts are withheld.
- Ask for advance notice of actual reproduction costs. West Virginia law bars a man-hour charge for search or retrieval.
- Request the matching order from the magistrate or circuit clerk, then compare its date with the actual facility departure time.
Under W. Va. Code §29B-1-3, a custodian must respond as soon as practicable and within five days, excluding Saturdays, Sundays, and legal holidays. The response may produce records, set a time and place for access, or deny the request in writing with reasons. It does not promise that a large production will be finished within that period.

Hampshire County Release Record Law
West Virginia FOIA begins with access to public records, subject to specific exemptions. Section 29B-1-4 can protect personal or medical information, investigative material, and records made confidential by another law. WVDCR security-sensitive video, incident, and investigative files receive added protection under state law. Those limits support focused requests for segregable event fields rather than broad demands for every file.
Public display time is not the same as government retention. No official source found for Hampshire County promises that a departed person remains online for a set number of hours or days. WVDCR records policy states that electronic entries and photographs are records governed by schedules, but it does not publish one web-retention period for all release material. A missing name cannot be described as deletion.
Question: Does release make every record public? No. Basic event information may be available, while juvenile, sealed, expunged, medical, victim, investigative, and security-sensitive material can remain restricted. Ask for the nonexempt remainder and the cited legal basis for any withholding.
Note: A precise request for a person, facility, date range, and named event fields is more useful than a demand for all records.
Two Hampshire Release Court Searches
One arrest may require two court searches. Hampshire Magistrate Court handles misdemeanors and the early phase of felony cases, including bail. Circuit Court handles felony adjudication and appeals from magistrate court. An initial bond entry can therefore appear in the free magistrate index while the final felony disposition appears in the circuit record.
Begin at the West Virginia Judiciary court-access gateway. The Magistrate Case Record Search accepts a first name, last name, or case number, but returns no more than 30 results and does not provide the documents online. Validate the result with the filing clerk. The Hampshire County court directory identifies both local offices.
A court result explains legal action. It does not fix the exact moment someone left Potomac Highlands. Pair the signed order with the facility departure entry. If dates differ, label the order date and physical release date separately instead of choosing one.
Hampshire Release Fees and Property
A records-copy charge and a jail processing fee are different. No authoritative source found for this project sets a standard copy price for a Potomac Highlands release report. Ask for an estimate before copies are made. West Virginia FOIA permits actual reproduction costs but does not permit a search or retrieval fee based on staff hours.
W. Va. Code §15A-5-8 separately sets a $30 processing fee at initial jail booking. The statute directs payment before release when possible and applies part of later trust-account deposits to an unpaid balance. A person not convicted of the booked offense can seek a refund by supplying the required court proof, correct contact details, and valid photo identification. A conviction on any of several booked charges, or on a lesser or related offense, can prevent that refund.
Personal property and credited funds have their own departure rule. Under W. Va. Code §15A-4-9, the superintendent must deliver credited property, money, and earnings when the person leaves or as soon as practical afterward. Questions about missing items should go first to the releasing facility with the OID, departure date, and a clear description of the item. The Sheriff is not the right first contact merely because the arrest arose in Hampshire County.
Expunged Hampshire Release Records
A Hampshire County record can lawfully vanish from public view. W. Va. Code §61-11-25 reaches qualifying arrest records, fingerprints, photographs, index references, and electronic data after certain acquittals, dismissals, diversion outcomes, or deferred adjudications. Section 61-11-26 covers some conviction records and defines sealing to include removal of electronic court information from public websites.
Eligibility depends on the case and statute. A waiting period alone does not prove that relief is available. When a court grants expungement, public agencies must follow the order and ordinary search results may properly disappear. Do not use stale copies to rebuild a record that the court removed from public access.
The official Judiciary forms gateway supplies the current petition materials. Forms help with procedure but do not decide eligibility. A clerk or qualified legal adviser can explain filing requirements, while the public search should respect the resulting access limits.
Note: A lawful no-result after expungement should be respected, not filled with an older photograph, index entry, or cached case detail.
Find Hampshire County Released Inmates
Start by determining which custody system likely held the person. A Hampshire arrest usually points to Potomac Highlands, while a state sentence can lead to another WVDCR correctional placement. Federal sentences use the Bureau of Prisons. Federal pretrial custody may involve the U.S. Marshals Service. An immigration handoff requires ICE channels.
- Collect the legal name, spelling variants, date of birth or age, arrest date, arresting agency, case number, and OID if known.
- Check the WVDCR Regional Jail OIS for present custody. If listed at Potomac Highlands, confirm the Hampshire link through charge and court details.
- If absent, check the WVDCR prison search for a transfer or active correctional status. Do not turn a no-result into a release finding.
- Search both relevant Hampshire court branches for the order or disposition that explains the exit.
- Check VINE for reported custody changes and WVDCR parole channels when supervision may follow release.
- Request the historical Potomac Highlands release record when an exact date, time, reason, or destination is needed.
- Branch to BOP, USMS, or ICE when the record identifies federal custody or an immigration detainer.
Roster warning: A person who leaves the live regional-jail list may have been released, transferred, reclassified, or moved under another hold. Absence alone proves none of them.
The compact standard is two records: a WVDCR or VINE event showing the Potomac Highlands departure and a Hampshire court entry showing the legal basis. No official county 24-hour or 72-hour release feed was found, so an exact event still needs the records route.
WVDCR Hampshire Release Search
The WVDCR Offender Search gateway separates Daily Incarcerations, jail search, prison search, and Escapees and Absconders. For a recent Hampshire jail case, choose the regional-jail route. For a person who entered state prison custody, choose the prison route. The public prison form accepts at least four OID digits or at least three letters of both first and last names.
| Search field or result | How to use it |
|---|---|
| OID | Use at least the first four digits when known. |
| First and last name | Enter at least three letters of each for the prison search. |
| Name and date of birth | Compare both before selecting a similar-name result. |
| Location | A correctional facility points to continued custody, not release. |
| Photograph | Use only as one identity clue, not sole proof. |
| Projected Release Date | Treat it as a changeable estimate, not an actual departure date. |
The official system warns that data changes quickly. A no-result can reflect the active-record scope, spelling, transfer, or access limits. It does not prove discharge. When the prison record has a projected date, preserve that exact label and obtain the later operational or discharge record before stating that release occurred.
The official WVDCR gateway shows the separate search choices used for Hampshire County custody research.
The screen reinforces why regional-jail custody, prison custody, and absconder status must not be treated as one database.
Note: Save the OID and check date because names can match, statuses change, and the public interface warns that data moves quickly.
Hampshire Release Status Sources
Match the system to the event it can prove. A live roster is strongest for a present listing. A court record is strongest for the judicial basis. A facility release entry is strongest for the actual departure. Federal locators answer different custody questions and should not be used for an ordinary Hampshire case.
| Status question | First source | Main limit |
|---|---|---|
| Still at a regional jail? | Regional Jail OIS | Current-custody oriented and not a historical release archive |
| Left Potomac Highlands? | WVDCR release report, release book, or VINE event | Must distinguish release from transfer |
| Why did local custody end? | Hampshire magistrate or circuit record | Order time may differ from exit time |
| Moved into state corrections? | WVDCR prison search | A projected date is not an actual release |
| Served a federal sentence? | BOP Inmate Locator | Does not cover every federal pretrial detainee |
| Entered ICE custody? | ICE ODLS and ERO | Exact-match rules, delay, and a limited recent-release window |
Question: What does “not found” mean? It can mean a spelling mismatch, movement, release, a restricted record, a juvenile matter, an outage, or a different system. Record the query and check time, then move to the next proper source.
Hampshire Release Alerts and Supervision
West Virginia VINE covers all ten regional jails and state correctional facilities. Use West Virginia VINELink for a named custody-status check or to register for a future change notice. Alerts can arrive through supported app, phone, email, and text channels. WVDCR warns that a transfer notice waits until arrival at the new facility, so a gap between listings is not proof of community release.
Parole and probation require different checks. The West Virginia Parole Board decides parole grants, revocations, and discharge matters. WVDCR Parole Services handles field supervision. Court probation belongs to the sentencing court and probation office. Hampshire County is served by the Moorefield Parole Office, even though its official page retains a legacy “Keyser” address in the URL.
For active parole or mandatory supervision, provide the full legal name, OID, sentencing county, and the source and date of the apparent release. For probation, use the Hampshire court case and the responsible judicial office.
Note: VINE is a notification service, not a certified release record or a Hampshire County historical release list.
Hampshire Releases to ICE Custody
A regional-jail “release” can begin ICE custody. ICE describes a detainer as a request for notice before release and for up to 48 extra hours so ICE may assume custody. If a Potomac Highlands record names ICE as the receiving authority, the event ends one custodian’s control but does not return the person to the community.
Use the ICE Online Detainee Locator System for an adult currently detained or recently released from ICE custody. Search with a nine-digit A-number and country of birth, or exact first and last name, country of birth, and optional birth date. ICE says its system can include people released from ICE custody within the prior 60 days, though upload delays and exceptions apply.
For a federal sentence, use the BOP Inmate Locator. It covers federal inmates from 1982 forward and can show a past release date or “Not in BOP Custody.” A Hampshire-area federal pretrial defendant may instead require the federal court docket and a U.S. Marshals custody-record request.
The Old Hampshire Jail Trap
The familiar phrase “Hampshire County Jail” points to a closed institution. The Hampshire County Sheriff’s jail history states that the Romney jail stopped operating when Potomac Highlands Regional Jail opened in 2000. The renovated old building now holds county offices.
Current adult custody checks belong in the state regional-jail system and at the Augusta facility, not at the historic Romney building. This local split also explains why the Sheriff website has no active county jail roster. The Sheriff remains the right source for sheriff-created arrest records, but WVDCR is the operational custodian for Potomac Highlands booking and departure records.
Potomac Highlands serves Grant, Hampshire, Hardy, Mineral, and Pendleton counties. Always reconcile the arresting agency, charge county, and court docket before describing a regional-jail record as a Hampshire County case.
Hampshire County Release Facilities
Two state custody campuses sit in Augusta, but they serve different people and legal systems. Potomac Highlands holds adult regional-jail detainees and correctional residents. J.M. “Chick” Buckbee Juvenile Center is a secure juvenile detention and commitment center serving all 55 West Virginia counties. Its presence in Hampshire County does not make its residents part of an adult released-inmate roster.
- Potomac Highlands Regional Jail and Correctional Facility: adult release, transfer, and WVDCR record paths.
- J.M. “Chick” Buckbee Juvenile Center: youth departures follow juvenile court, Division of Juvenile Services, family, and authorized-party channels. No public adult-style roster should be promised.
For Potomac Highlands, a community release is checked through the WVDCR departure record, court order, and VINE event. A transfer stays within custody. For Buckbee, confidentiality controls the route, and public adult search tools are not a substitute for the lawful juvenile process.
